How it works
This contest continues to grow rapidly. Increases in sponsors, prizes, and judges mean this document will be updated and change often.
Purchase is necessary for “most” categories. To enter register an account at www.circuscompetition.com/contests and purchase entries. Several options are available for the quantity of entries purchased. An upload option is available to submit your files.
Prices are in USD. Applicable taxes are due at time of purchase.
Once you've uploaded your images they are officially entered into the contest. A jury will select finalists based on category dependent criteria after the contests end. A people’s choice award option will be available
Photography, Cosmetics, and Digital Illustration contests have separate subrules as does each category. After reading the general rules, please read the subrules.
In order to enter the Contest, you must agree to these Official Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Sponsor with respect to the Contest.
ELIGIBILITY OF PARTICIPANTS
To be eligible to enter the Contest, you must be: (1) 18 years or older on the submission date, (2) not participating from Quebec, Iran, Iraq, Syria, North Korea, Sudan, Libya, Liberia, Zimbabwe, or Myanmar (Burma); For clarification we will not transact within those jurisdictions for various legal reasons, but if a resident of those jurisdictions participates outside of those regions it is acceptable. The Sponsor reserves the right to verify eligibility and to adjudicate on any dispute at any time.
The Contest is open to any professional, student, or amateur artist. The Contest is subject to all applicable laws in each jurisdiction where residents are eligible to participate in the Contest and void in any jurisdiction where otherwise prohibited or restricted by law.
ELIGIBILITY Of IMAGES
Each entry must comply with the terms and conditions.
Mail-in entries are not available for this contest. Only digital entries submitted through the accounts in the contests section will be accepted at www.circuscompetition.com/contests . Only online entries will be eligible. No physical print or film submissions will be accepted for entry into the Contest.
Photographic submissions -The photograph need not be taken with a professional camera but it must be in a digital format; scans of negatives, transparencies, or photographic prints are acceptable. *Digital manipulation/enhancement is allowed in photo categories HOWEVER it will add additional judging scrutiny to discern the quality of manipulation, and whether the manipulation enhances or detracts from the photography. The amount of manipulation allowed is dependant on the category so check the category’s special rules and exceptions. Unless otherwise specified, if the art is determined to be more than 25% artifice ( at the sole and uncontested discretion of the judges ), such as obscuring a significant amount of the base photograph with special effects then the image will be disqualified as a non photograph. Again some categories have special rules within them that may allow for more or less artifice. Fish-eye lenses are acceptable. High dynamic range images (HDR) and stitched panoramas are acceptable only if the combined parts are all made around the same time.
Images that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud in the sole opinion of Organizer. When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person's art.
Cosmetics submissions - Photographs owned by a third party, are acceptable IF license has been secured to permit your submission to this contest and allows the Sponsor to use the images as outlined in all the terms and conditions. The photograph need not be shot professionally. The cosmetics work work will be the primary criteria HOWEVER Please note that a better photograph can translate the quality of the artists work. *Other than contrast and color correction no digital retouching can be done to the makeup. Elements outside the makeup may be retouched.
Digital Illustration submissions - The art can be created in any digital software. *The use of photography is allowed in digital illustration categories. The illustration art must be at least 75% of the content work and the photography must support not define the work.
Submission Requirements and Limitations Images must be suitable for viewing by the general public 18 and up, all ages if you are aiming for the people’s choice award; The image must not, in the sole and unfettered discretion of the judges, and any sponsors, contain obscene, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the submission is created; The Sponsor reserves the right to reject and remove any submissions deemed inappropriate without recourse or explanation.
Images submission must be jpegs high quality no smaller than 2100 pixels on any dimension (7 inches at 300DPI), and be bereft of logos and watermarks obscuring the quality of the image. A higher resolution image is needed to assess the details of your work.
Images must be in digital format. Only online entries will be eligible. Images owned by a third party, or the use of any trademarks, service marks, logos, brands, or products owned by a third-party are not acceptable for entry into the Contest. If a submitted image includes other people, entrant must be prepared to provide a signed written personal release from all persons who appear in the image authorizing use of the image. Entrants do not need to send release(s) with submissions but will be contacted if personal releases are needed. Failure to provide the required releases will result in disqualification of the entry.
Judges consider the following this when examining the image itself. -How well does the art fit the relevant category? -How original is the art? -How creative is the art? -How much does the art connect or move the judge?
A panel of supporting judges will sort through submissions to filter out non qualifying images, and to select a broad range of finalists who will be provided to our lead judges for final consideration.
A People’s Choice option is being made available. By optionally selecting to partake in the people’s choice during upload you allow your image to be voted on by those who have accounts with our contest. Each image chosen to be submitted to the People’s choice will be made visible to the public in an open gallery. Images submitted to the People’s choice should be safe for work, and safe for public viewing.
Voting is a simple click vote once per day. Anyone who registers a free account with us can vote on an image for free, and keep revisiting each day to do so. The person with the most votes wins. 1 person voting for 100 days, OR 100 people voting in 1 day equal the same results.
Understanding that we cannot police every image that is uploaded. You agree to take responsibility for any mature content and hold us not liable for any complaint, suit, or legal action taken in response to your image being made public.
Your address and contact information is kept strictly confidential. Your user name may be displayed as the owner of images in the people's choice category. If selected as a finalist your name may be published unless you advise the SPONSOR of any concerns regarding this. The Sponsor will on occasion email contest entrants pertaining to our events. By entering the Contest, you are granting to the Sponsor permission to email you in this manner, to notify you of winning, and/or to notify you of possible problems with your entry or other contact that the Sponsor deems necessary at its sole discretion.
The North American Circus Competition reserves the right to prohibit entry from any person who it believes to be abusing these Rules. Abuse includes entering false information, exploiting the system, or other uncouth behaviour. As such, The North American Circus Competition makes an effort to contact people who are banned in order to explain what has occurred and to facilitate communication. However, sometimes this is not possible. If you have been banned and wish to discuss the situation, please contact The North American Circus Competition at email@example.com .
ART CONTEST DEADLINE EXTENDED TO NOV 14th.
-The contest officially launched March 3rd 2014. -The Contest is closed for submissions at 11:59pm EST November 14th, 2014. -Public voting remains open until 11:59pm EST on Dec 24th, 2014. -The month of November will be used for deliberation of the lead judges to pick winners. -The month of December will be used for contacting finalists and verifying ownership, model releases, secure high rez files, and other necessary processes. -Announcements of winners will take place before Jan 1st 2014, and we will deliver prizes in the subsequent 2 months.
PRIZES, DELIVERY, and NOTIFICATION
Each category will have it's own specialized prize descriptions. These are only general prize rules.
Only the selected finalists will be notified by email or phone. Prize winners will be announced at a live event in Toronto to be scheduled.
If finalists cannot make the live presentation in Toronto, prizes will be shipped within 90 days of the event through Canada Post to those addresses provided by Contest winners on their Registration Form and will include only those delivery guarantees provided by Canada Post. You can be located anywhere within the world to participate except where excluded, but we can only pay for shipping prizes to US and Canadian addresses. Additional shipping costs and instructions can be provided by the applicant.
Where applicable, duty and customs fees will be the responsibility of prize recipients. Featured prize values in the Prize List are suggested retail values, as provided by prize sponsors.
Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason, including export laws. Value is subject to market conditions, which can fluctuate and any difference between actual market value and actual retail value will not be awarded. The prize may be subject to restrictions and/or licenses. Contest Entities have not made and Contest Entities are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize, regarding the use, value or enjoyment of the prize, including, without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the prize or any components thereto.
Payments to potential winners are subject to the express requirement that they submit to the sponsor all documentation requested by the sponsor to permit it to comply with all applicable federal, state, provincial, local and foreign tax reporting and withholding requirements. all prizes will be net of any taxes sponsor is required by law to withhold. all taxes imposed on prizes are the sole responsibility of the winners.
In order to receive a prize, potential winners must submit the tax documentation requested by Sponsor or otherwise required by applicable law, to Sponsor or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winner’s country of residence. The potential winners and finalists are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a potential winner or finalist fails to provide such documentation or comply with such laws, the prize may be forfeited and Sponsor may, in its sole discretion, select an alternative potential winner.
INTELLECTUAL PROPERTY RIGHTS Publication and License.
By submitting, you confirm that the images are lawfully yours and you retain full copyright discretion. As between you and Sponsor, each entrant shall retain ownership of all intellectual property rights in the entry (including moral rights) subject to these Official Rules. However, by entering the Competition, and to the extent allowed by law, entrant grants, but solely in relation to the promotion and/or advertising of the Contest and it’s exhibitions, you grant the Sponsor, the Sponsor’s affiliates, licensees, promotional partners, developers and third party marketing entities ("Permitted Users") a non-exclusive, 48 month, worldwide, royalty-free license to modify, rearrange, copy, reproduce and adapt the images only to fit the format required for product web pages and marketing materials; The copyright owner give a licence to publish and use the images and to publish and use the images themselves and the content of and elements embodied in the images, including any names, locations and likenesses, for the duration of the rights, in any and all media, including but not limited to digital and electronic media, computer, and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner without further review, notice, approval, consideration, or compensation ONLY IN THE CONTEXT OF THE NORTH AMERICAN CIRCUS COMPETITION . Sponsor, its affiliates, partners consultants, will not commercially exploit the images and all such rights of commercial exploitation remain with entrants.
LIMITATION OF LIABILITY
Entrant releases and holds harmless Organizer and the "Promotion Entities", from all claims, demands and liabilities arising out of or relating to the Contest, Entrant's participation in the Contest and related activities. The entrant shall not assert against any party running the contest any claim of any kind whatsoever regarding the image including, but not limited to, actions based on copyright, moral rights, or trade-mark infringement, passing-off, misappropriation of personality, invasion of privacy, publicity or defamation.
Organizer is not responsible for:
1) any typographical or other error in an Entrant’s submission(s), printing of the offer, Contest administration, or the announcement of winners and prizes;
2) any electronic transmission errors resulting in interruption, deletion, delay, destruction, or unauthorized access to or alterations of entry materials;
3) any technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive Submission information on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof.
The North American Circus Competition cannot be held liable for any failure of its websites during the Contest. The North American Circus Competition is not responsible for loss, damage, technical problems or delays that may occur during digital transfer of images.
The North American Circus Competition is not responsible for technical failures on the part of Contest software or human error which could result in inaccurate postings and notifications or for email or phone notifications that are rejected or do not reach a selected entrant.

NOT AN OFFER OR CONTRACT OF EMPLOYMENT.
Under no circumstances shall the submission of an entry into the Contest, the awarding of a prize, or anything in these Rules be construed as an offer or contract of employment with either the Sponsor, or the Contest Entities. You acknowledge that you have submitted your images voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and the Sponsor or the Contest Entities and that no such relationship is established by your submission of images under these Rules.
MODIFICATIONS OF RULES/TERMS OF SERVICE
The Organizer reserves the right to make modifications to the Rules/Terms of Service. Changes made to the Rules/Terms will be posted on the website in this section or notification will be sent to users by email. Continued use of the website constitutes acceptance of those changes.
RIGHT TO CANCEL OR SUSPEND CONTEST
If the Contest is not capable of running as planned, due to a computer virus, bug, worm, Trojan Horse, tampering, fraud, technical failures, or any other causes beyond the Organizer’s control that adversely affect the administration, security, or fairness, of the Contest, the Organizer reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and to cancel, modify, or suspend the Contest or any aspect thereof. The Organizer will not retain any rights in the submitted images and will return the fees submitted with each entry if the Contest is canceled or terminated.
JURISDICTION OF LAW
The Contest is governed by Ontario law. Entrants consent to personal jurisdiction in Ontario courts for any dispute or litigation arising from or relating to the Contest. Venue will only be in the City of Toronto, Ontario.
To the extent permitted by law, Entrant waives the right to litigate, to seek injunctive relief, or any other judicial or procedural recourse of a dispute or claim arising from or relating to this Contest.
A winners list will be made available to the public at a later date, but names will only be released based on permission granted. Otherwise we will list user ID's.
